1. Introduction
1.1 Booking payments made through the Site are handled by a third party payment provider.
1.2 These terms and conditions govern the relationship between One Heights 58 and any person using or accessing the site and any content or services available through this site as a guest or potential guest
Guests include people who use the site to access information about and book accommodations, whether for business or leisure purposes. Holiday rental bookings through the Site are subject to these Guest Terms and Conditions.
1.3 One Heights 58 does not authorize anyone to register on this site unless they are able to form legally binding contracts. As a result, the Services may only be used by persons 18 years of age and older.
1.4 One Heights 58 may revise these Guest Terms and Conditions from time to time for reasons such as a technical development, a change in business, new or changed or discontinued products or features, or as a result of a change in applicable law.
1.5 One Heights 58 may ask you to provide personal information directly. for example, One Heights 58 may ask you for your contact details, such as full name, telephone number and email address, in order to enable certain functions, such as booking your accommodation.
2. The basics
2.1 This site is a place where guests can view listings of and obtain information about properties for rent (“Properties”). We may also offer other tools or services to allow users to communicate with each other and enter into rental agreements.
2.2 The Site acts only as a venue for users to communicate with each other. Rental contracts are only concluded between the Guest and One Heights 58.
2.3 Guests are responsible for and agree to comply with all laws, rules and regulations applicable to their use of the Site, their use of any tools, services or products offered on the Site and any transaction they enter into on the Site or in connection with their use of the Site.
3. Property listing and interaction with One Heights 58
3.1 If a Guest finds a Property of Interest, an inquiry may be sent to One Heights 58 (an “Inquiry” or “Inquiries”).
3.2 One Heights 58 will then communicate directly with the Guest in connection with the Request.
3.3 Where One Heights 58 has enabled online bookings, the guest may make a booking online, which will be approved or rejected by One Heights 58 within 24 hours.
For online payment, a guest whose booking has been confirmed by One Heights 58 can pay with their credit card or other alternative payment methods, if available, through the checkout. Online credit card payments are processed through the payment gateway provided by our third party payment providers.
The online payment service is subject to the terms and conditions of the external payment providers.
3.4 One Heights 58 has made commitments to properly handle and protect all such information in accordance with applicable legal and regulatory requirements and best practices.
4. Intellectual Property
4.1 All content appearing on the Site is protected by copyright and database rights. Reproduction of the site in whole or in part, including copying text, images or designs, is prohibited.
4.2 Guests are permitted to download, display or print individual pages from the site as evidence of an agreement with One Heights 58 and to keep a copy of their bookings.
4.3 To the extent that guest reviews or other content may contain trademarks or other proprietary names or marks, guests agree that they have the right to use such names or marks.
5. Guest Accounts, Communications, and Reviews
5.1 Guests must only provide accurate and truthful information about their identity, including country of residence, in their Accounts and other communications on the Site, including reviews of Accommodations.
5.2 Messages sent through One Heights 58 systems may only relate to genuine booking requests. We do not tolerate spam or unsolicited commercial electronic communications of any kind. It is prohibited to abuse the systems of One Heights 58, such as sending unsolicited commercial communications (spam) or disclosing users’ personal data to a third party, unless you have the explicit consent of the user.
5.3 Guests who have booked through the Site may post their reviews of the One Heights 58 properties (“Guest Reviews”) on the Site. One Heights 58 is given the opportunity to view and respond to guest reviews.
One Heights 58 will remove the content if it notices or is notified that the content is illegal.
5.4 One Heights 58 adheres to its privacy policy.
6. Right to Delete Content
It is the responsibility of guests to ensure that their communications and content posted through or in connection with the site, including guest reviews and communications with One Heights 58, do not violate the law, the rights of any person or entity, or contains false information or personal insults , anything defamatory, defamatory or defamatory, anything that infringes copyright, data protection law or the content guidelines. One Heights 58 can view and delete or change any data on the site when it is no longer accurate or up to date. 7.1 We do not provide guest liability insurance; regardless of whether or not a user obtains insurance coverage through one of our third-party providers. Guests are advised to take out appropriate travel insurance to cover their booking for theOne Heights 58 accommodation, including in the event that they need to cancel their booking. It is the responsibility of the guest to ensure that the insurance they purchase is adequate and suitable for the specific needs of the guest.
7.2 As a consumer, you have certain rights (including that, for services, we will provide them with reasonable care and skill). Nothing in these Guest Terms and Conditions affects your statutory rights.
7.3 To the fullest extent permitted by law, One Heights 58 shall not be liable in the event of any claims, actions, demands, recoveries, losses, damages, penalties, fines or other costs or expenses of any kind, in particular including reasonable legal fees , (“Claims”), made or caused by any third party alleging, arising out of, or related to: (a) any material or content you submit to the Site; (b) your use of any content on the Site; (c) any breach by you of these Guest Terms and Conditions; or (d) your use of the Property. One Heights 58 will immediately notify you of any such Claims. If you are dissatisfied with the Site or if you disagree with any part of these Guest Terms and Conditions, your sole and exclusive remedy against One Heights 58 is to discontinue use of the Site.
7.4 Refunds are processed immediately, but the timing for receiving a refund will depend on the payment method and applicable payment system. Refunds will be processed in the currency of the original payment. Any currency conversion is done by the relevant bank using their current exchange rate which may differ from the exchange rate used when you originally paid. In addition, bank charges incurred by the guest during the booking process or as part of the refund process may be deducted by the bank from the amount refunded and will not be refunded by One Heights 58 in such cases.
8. Miscellaneous
8.1 These guest terms and conditions are governed by the laws of Belgium and are subject to the non-exclusive jurisdiction of the courts of Belgium, without prejudice to the applicable law and jurisdiction of the courts where the guest resides.
8.2 In the event of a dispute between the guest and One Heights 58, the guest may use a conventional mediation procedure or other alternative dispute resolution method as defined by law.
